The firm is actively involved in identifying, analyzing and resolving complex insurance and reinsurance coverage issues. The firm's services are frequently sought to ascertain both the breadth and limitations of coverage and to assist in the development of progressive policy language. The firm also defends insurers and reinsurers on coverage claims interposed by their insureds and reinsureds, and prosecutes declaratory judgment actions on behalf of insurers and reinsurers.
The firm has significant experience in handling all aspects of environmental claims and environmental coverage issues.
The firm has developed a practice to address environmental/asbestos/mass tort issues. The firm's attorneys work closely with clients to address all aspects of aggregation, allocation and coverage issues which pervade this area of reinsurance. The firm has been particularly successful in assisting clients to craft protocols for the consistent handling of the delicate issues which arise including questions of ultimate responsibility for the expense of declaratory judgment actions and the manner in which dates of loss are selected.
The firm has extensive experience in the defense of third-party casualty claims on behalf of insureds and self-insureds, including general construction accidents, construction defect claims, premises liability for commercial and residential risks, retail and recreational industries, municipal liability, homeowner exposures and personal and commercial automobile. The firm also represents several multi-line transportation clients in relation to claims arising out of their operations.
MARINE AND TRANSPORTATION
The Marine Department has extensive expertise in handling all aspects of marine and transportation claims and litigation. The department's concentration includes litigation, both ocean and inland, involving personal injury and property damage, marine insurance coverage, shipyard accidents, Limitation of Liability proceedings, Jones Act and Longshore and Harbor Workers' defense, cargo subrogation and defense, terminal and tower's liability, truck and rail claims, charter party disputes, marine construction accidents, products liability and salvage.
The firm maintains a No-Fault department that is involved in all aspects of the practice, from submission of claims to litigation and larger scale coverage actions. The firm's primary goal is to think outside the facially rigid rules imposed by regulation and to identify the avenues that provide clients with an extra layer of protection against specious claims.
In this area, the firm is most active in the representation of insurance companies and the defense of all forms of product liability matters ranging from claims relating to automobiles to heavy construction equipment.
The firm's Property Department provides complete risk consultation and claim handling services, including: risk analysis, review and development of policy language; advice on the handling of first party claims, arising out of property, fire and theft insurance policies; jewelers block and fine arts policies, pre-litigation investigation of claims, examinations under oath, document review, coordination of experts, and coverage analysis. To the extent that claims result in litigation, we afford full defense of all first and third party liability claims as well as subrogation where appropriate. Our professional staff is experienced in handling complex litigation issues, interposing fraud and arson defenses, and litigating coverage disputes. We have successfully defended insurers against claims of bad faith in which punitive damages have been demanded.
The firm represents its clients before the National Association of Insurance Commissioners (NAIC), the National Conference of Insurance Legislators (NCOIL) and all state insurance departments. The firm participates in the periodic meetings of the NAIC and NCOIL, and serves on a multitude of advisory and other committees established to address critical issues confronting the insurance industry and its individual clients. Through its working relationships with these regulators, the firm is well equipped to recognize, address and resolve various regulatory issues as they arise. Accordingly, the firm participates in the crafting of insurance legislation and monitors, on a daily basis, the ever-changing laws, rules and regulations which govern the industry.
